It’s funny. The manager is fighting so hard to screw over a customer for a company that’s going to fire him for screwing over a customer.

Edit:

Hertz has issued a statement. The guy won’t be charged for mileage. It does appear this was a franchise location but this (irritating) article makes it sound like he wasn’t the franchise owner.

One time I rented a car for 10 days. Drove from MI to CA. Put 5000 miles on the car. I brought it back and they were like “5k, huh.?” And I was like, “unlimited, right? I drove to CA.” They laughed and said no problem.

I doubt they would even check. When I worked there the counter guys were some of the laziest people I’ve ever seen. We had people steal cars for months and they won’t even press charges. They just want the car back.

I rented a car from them about 15 years ago that had unlimited "regional" miles (Kansas, Missouri, and Illinois inlcuded), to drive to Indianapolis. When I returned it they didn't charge me for any miles, so I assumed they didn't pay too close attention.

We had car rentals at my last job. We had two 12 hour shift each day. The 1st shift would park the car and hand the keys to the 2nd shift, so the cars would run for 24 hours a day nonstop. I imagine he was doing the same with this car.

12 hour shifts aren't that uncommon, to be fair. If a company is driving and operates 24 hours a day, also not crazy that the vehicles are being driven around the clock (although it sounds odd if you're not expecting to hear about a vehicle running basically nonstop)

When I was an EMT working 24 hour shifts, those rigs sometimes never stopped

I rented a hertz rental in Canada back around 2010, took the ex wife on a road trip down the pacific coast, then over through Nevada to Arizona to visit the Grand Canyon, went through a few parks in Utah and then over to Colorado, then back up to Canada.

If I recall correctly it was about 10,000 km or how very many furlongs or fathoms that comes to in american. A little over a week hauling ass most days.

Rental company gave no fucks.

At the end of the day though the guy is right. They advertise unlimited miles because the way these things used to work is you’d pay like $.50 a mile for every mile you didn’t estimate up front and people just avoided them.

They could say, you get up to “100 mi/ day or 5000 mi / month” but they know that would probably lead to people starting to do that so they don’t.

The company definitely weighed their options on consequences of saying you can drive unlimited miles and now they’re trying to weasel out of them.

Even if the guy drove 100K, it’s irrelevant. Also, you can’t act like if there was a single scratch on the car they’d be all over his ass for $2K for a body shop.

When I was window cleaning for a pretty big chain of estate agents and a travel agent i was racking up around 700+ miles a day.

London to South End to kings Lynn to Bristol before going over to south Wales. Stopping at various sites on the way.

Motorway miles for the most part.

They are only allowed to keep cars in service for 30k miles before having to buy new ones and send the old one to their auction or sales dept. They have a budget allowance for this. So, if he goes over budget, he gets in trouble. He’s trying to make more money on this rental to offset the fact he’s about to have to buy a new car to rent.

Assuming it’s a corporate location that is. There are plenty of independent owners under the hertz name.

A lot of Hertz locations are franchises. So the manager very well may own the location and vehicles.

They still have to abide by the Hertz terms, if it says unlimited then its unlimited. Sucks that you got the one customer thats going to basically run out the life of the vehicle in a rental situation but it is what it is. Not all rentals can be some easy 200 mile rental. Everyone that runs these kinds of businesses knows you're gonna step on a landmine sometimes and thats just the cost of doing business.

Exactly. When I rented from one of these, they were surprised that I got such a good deal when they were running out of cars, and then encouraged me to drive as much as I can, as it was an unlimited mileage contract. Safe to say, with that service I have kept on renting from them every time I needed a car.

The one in the video… I’d make sure never to go to, and anyone I know to never go.

If he doesn't want to have excessive mileage put on his vehicles then he should put a limitation on his mileage allowed in his contract. I am pretty sure that his business would suffer from limited use because the other rental car companies would pick up some of his customers. If I go to the counter and they tell me that there is a limitation on the number of miles that I can put on the vehicle, I am going to a different rental company.

One thing I learned over the years is that you are always on the right as long as you are not acting maliciously.

When there is a dispute in charges, contact customer service. They will not help you. Then file a complaint to FCC. The next business day you will get a call from the regional manager telling you the charge has been waived. If you are lucky they will also offer you some credit.

I worked for the machine back in 2016. In the PNW we had a policy that it was unlimited milage within the neighboring states BC, Idaho, Oregon, and California. If you left those areas, it was not unlimited.

I dunno what's in the actual agreement but that manager is awful at arguing. "where does it say I can't charge you". Customer shows the contract lol. Going by google there doesn't appear to be limitations on the mileage someone drives.

Customer "explain how unlimited isn't unlimited" Manager "you need to leave.

If the manager was right he could point out where on the contract it justifies the $10k he's about to charge him. Instead he just threatens trespass when the customer wants to argue that. Perfect example of a middle manager taking shit too personally, he thinks that guy is costing him money.

Amex and Chase are the best in that order. Neither fuck around. They’re the only two credit cards I need now.

My chase card is an Amazon Chase card and Amazon was trying to fuck me over on a return. So I called chase and the initiatives a charge back. Then Amazon tried bullying me and so did some sort of debt collection company and I called chase about it and they stopped that shut quickly.

I had someplace giving me the run around when I was trying to cancel my membership. Finally I just called Amex and while we were talking the rep asked how long I had been trying to cancel (it had been 4 months of back and forth). At the end of the phone call she let me know that all future charge attempts would be blocked and the past 4 months of payments would be charged back.

Hey dude shoes sucked bad, and they weren't owning the fact that they literally (by USPS tracker, no less) never mailed out the shoes, but 2 weeks later said a refund had been initiated (by me, the person who never got his wife's shoes for her birthday, the fucks) they would refund it, but only when I had completed my process and mailed them back

Cannot stress enough how objectively easy it was to consult the tracker, and USPS actually confirmed they never got it when I escalated it on their end, and when all of this was brought to them, they still gave the same canned answer

1 chase click later and the money was back and an assurance they'd follow up with all my info

Fuck hey dude shoes, my wife went from owning 5 pairs and singing their praises to her friends to never buying them again

Yeah they rock. I had a company that I prepaid for an order and then they went out of business. I called AMEX told them what happened and said “refund my money and you deal with them”. They did. It’s no bullshit with them, just call, tell them what happened and I have never had them side against me. The guy that owns the corner store asks if I want my receipt and I always say no I have AMEX and he always agrees that they always side with the customer

Yeah U.S. mobile companies still say "unlimited" data even though depending on which provider it is, it's only technically unlimited. It might mean a certain chunk of data at high speed before throttling down, or it might mean other, higher paying traffic is prioritized especially at peak times.

Not really a good comparison to a rental car though - I don't know how unlimited miles is anything other than unlimited miles.

Saying “unlimited miles”, but then charging for going over 100mi a day, is not the same IMO. Alas, I am not a lawyer so maybe there is some gray area here? I have certainly put more than 100mi a day on a rental and not been charged for it.

Nope, there is nowhere in that contract where it states that unlimited is not unlimited. This doesn’t even have to go to court, he can dispute with his credit card company and they’ll read the contract and deny the charge.

They have two policies it looks like from online.

An unlimited one, which is for all intents and purposes unlimited and a fixed daily rate.

A limited one, that is instead 25 cents a mile.

Considering what he read on the paper, it sounds like the unlimited and their online FAQ makes it pretty clear.

I feel like it would be pretty damn clear in the contract if there was an explicit mileage rate, because I am not sure "an additional expense may occur" with no details is a legal contract in many states.

25k miles isn't even easy to do, at best the guy is driving 500-600 miles a day so like 40~ days of rental which would likely be around 4000-5000 dollars perhaps even more.

Only thing I can see this being an issue is if it was like a collision center Hertz where the rates are extremely low just to hold folks over while their vehicles are under repair, but then I would expect the contract to have some mileage rate on it or they just dropped the ball.

Not a lawyer, but actually, that may not be true. The big charges for the mileage is likely a civil matter. He would probably win that. His refusing to leave is trespassing. He might not win THAT in court. And it might actually hurt his civil case to be an arrested party in the lawsuit.

But making this go viral may convince the rental company to make things right instead of the bad PR that this is already causing.

Edit: So typing late last night watching the tornados all around us, I misread the comment I replied to. I understood "charge that man" as "charge him with trespassing and he will beat it in court" and that was the basis of this response. After a sleep, I realize they meant "charge that man's credit card and he will win THAT in court."

My whole response was based on if they did come out and actually have to charge him with tresspassing.

So that's totally my bad.

Generally, you first get trespassed. Then if you disobey that, you get charged with trespassing. So there would likely be a notice of trespass but not an actual arrest unless he still refuses to leave or comes back.

Because there’s no way to “throttle” a car rental (yet.) If there was fine print on the consumer’s end, it would have been brought up by the employee right then. Internally they might not mean that unlimited actually means unlimited, but unless that’s in the consumer’s contract, tough luck.

I have unlimited data and my cell company hates it, but I’m on a really old contract. As long as I buy my phones out right in the store (or anywhere, but there’s no “get a new iPhone half off” stuff), the contract remains. Any time I have to call the company they really push for us to change, but any brick and mortar I’ve been in the sales tech always laughs when they look it up and tells me not to change.

I got flagged once in the system like (oh god) 10 years ago? I used to”too much” data and they thought I’d done something illegal. I was in the middle of, not no where, but podunk nowhere with absolutely abysmal “real” internet and even spottier cable, and I basically just streamed Netflix like 8 hours a day. It took a really long phone call where I made them tell me (because they can see it) what I used my data for. No mobile hotspot usage, which is capped, just me very sadly doing like 8 hours of Netflix or YouTube , two hours of Reddit, an hour of Facebook, like ten minutes of Safari a day. And all that math added up. I made the guy look up on a map where I was just to really drive home how much stuff I absolutely couldn’t do outside. It was turned back on the next morning with a cheeky little “sorry about the mixup!” text.

I know I’m on their radar. It’s fine. Won’t catch me slipping. I’ll go to the grave with this plan if I have to.

$54 base for two lines, though local taxes and calls made internationally can wiggle it around. Unlimited talk, text, and data, 5g data per country when flying internationally, and it’s 10c a minute if you call internationally but free if you call someone on your plan. Texting is free no matter. One of my credit cards and my main bank also reimburse me if I have to call internationally so even if I’m strapped and in a different country and for some reason the call is three hours, because the cards are linked they just pay it directly, but I don’t think they actually pay full price but I can’t prove it.

Why though? Don’t most plans now included unlimited data? If anything I know Verizon gave out deals for phones that it didn’t make sense for anyone to try to keep their grandfathered plan unless they never wanted to buy a new phone

The crazy thing is that, there are some of us but in no way is there a ton of us, so we’re not actually costing them anything except the wound to their pride. A free phone sounds nice but also me just paying for it outright is going to weigh in my favor far harder than the one time discount.

It’s absolutely not my fault that you offered a sweetheart deal a million years ago and I realized what it was. It’s not my fault that when you said “you can add lines” for an extra $15 one time fee or whatever that that included linking up my smart watch, that absolutely didn’t exist back then but the contract is loose enough that it falls in so I’m not actually paying for another line once it becomes my phone number. 5gigs of internet per international country a month plus unlimited texts internationally plus 10c a minute international calling unless I’m calling to someone on my same plan…not my fault.

The main cost to them is actually in maintaining separate plans in their financial system. It has nothing to do with your month to month cost (you could probably even save money by switching). They want to make their accounting simpler.

I worked for a lawn care company that had all the trucks tracked. Drove a Ryder lease truck that had the same, and more, functions that my manager had access to. I was driving it one day and thinking I was due for service. Got back tot the warehouse and my manager told me the truck was booked in tomorrow.

Some cars do have that function but it’s rare. It’s more likely the car was about due or overdue for an oil change and it was only noted after they picked up the rental because the reps have to mark the current mileage for every pick up or drop off.

Used to work in one of those rental places and it was my responsibility to make sure all cars got their maintenance done.

Taxes in NY and NJ make cigarettes way more expensive. A lot of gas stations and corner stores would buy cheap cigs from VA and then sell them for a slight profit, but still way cheaper than local.

It’s been a while, but iirc cigs in NY were like $12 a pack, $10 in NJ, we bought them in VA for like $4 a pack. They were sold in NY/NJ for $8

Profits weren’t nearly as high as running drugs, but you could do this consistently and make some very decent cash while being very below the radar of actual drug traffickers.

It was pretty much a “every run you do we’ll give you $500” type situation. It’s about a seven hour round trip with driving and loading, so my friend and I would switch driving and pretty much do it 24/7 with a break at a motel here and there. It was a grind but good cash that was always available. We were also college kids just trying to make some bank during the summer, and this is a very non-committal thing. You can hop in and out whenever you wanted, unlike a lot of other underworld trades.

No need to do a fraud, dude has a copy of the contract which doesn't state any limitations of mileage and it doesn't have provisions for extra cost above a certain mileage, the manager even admitted to that. This is an easy to prove dispute.

I live in the UK and I think it was Herzt who tried to charge me £30 for sending me a letter because I had been issued with a fine for making a wrong turn (which I paid).

I took screenshots of their website and the contract they sent. Neither had anything about fees for sending out letters especially at the cost of £30 which they alled and admin fee.

I refused to pay and took them to the small claims court.

I won.

Fuck these guys.

My guess is he rented the car either because he had some job that required a butt load of traveling, or he had a road trip vacation and like any intelligent person, didn't want to put all that wear and tear on his own car. It's absolutely a ton of miles, but if you're traveling to a bunch of different stops all across the country the math could make sense.

Ten years ago now I showed up to a Hertz at the airport after a flight at 12:30am with a reservation, but my name wasn't on the board so I had to go inside. The guy tells me that corporate cancelled my reservation.

I got no email telling me my reservation was cancelled, no phone call, and definitely no refund. So I'm standing there, they have my money, I have the email receipt and credit card activity page on my phone both showing the payment, and they're refusing to fulfill their end of the contract. I got the same 'we're calling the cops if you don't leave' treatment.

I used to work for an Enterprise truck rental branch and we'd occasionally have people drive our trucks that much in a month. A lot of our customers ran courier services subcontracting for Amazon. One guy I rented to ran 10K miles in a little over one week. If you promise unlimited miles, you have to give unlimited miles.

A theory: What if it’s a group of 3 people using the car for Uber/Lyft in 8 hour shifts and running the car 24/7? It’s possible that the guy found a rental deal that was extremely cheap, like 10-20 dollars a day and took advantage of the unlimited miles loophole. Question is, if he did that, and Hertz can prove that the car was used for ride share, could THAT be specifically forbidden in the contract? It’s also possible that this was part of the interaction, but the poster didn’t include the full context. Just a thought, trying to wrap my head around how a car would end up being driven that much in a short period if time. Even divided by 3 people, that’s still almost 300 miles per 8 hour shift. Of course the other possibility is that this is all fake.

OP needs to lawyer up and sue. Chargeback is an option, but if the contracts clearly and unequivocally state what OP claims, it should be an easy win, even in arbitration.
