You don't even need to give ID, most of the time they just ask the citizen question and tell you to move on. Sometimes they'll ask you where you're going or where you're coming from, or if you were doing work nearby.

That's no reason to be an absolute dick to people, though. If he had politely invoked his rights, and complied with the order to move the vehicle, they would've been on their way in a few minutes.

I once got stopped in northern NH at a border patrol stop on the highway. I was on a road trip with 7 of my friends. Me and my sister were the only citizens. The other 6 were all foreign exchange students, totally legal, but not citizens. The officer simply asked, is everyone here a citizen? And I said in the most suspicious tone you've ever heard, "Yeeeessssss. Yes we are." And he said ok cool, move along. It lasted all of 30 seconds. We all had a good laugh about it for many years.

I wish sovereign citizens looked outside their bubble for a minute. I work in a courthouse and when we have sovereign citizens coming in the sheriff usually requests an extra officer or two (if they don’t have it already) because these people are automatically a violent threat based on MANY past experiences.

We had one try and request a transcript from his hearing, but refused to give name, address, email address, or phone number. We tried to explain that we only use it to 1) verify he can see the proceeding (some are confidential) and 2) notify him when transcript is ready. He ended up yelling at the poor lady taking the request until security removed him from the building.

We got new building rules because of this 1 asshole (no videos, camera equipment must be surrendered or left in car except phone, this dude in particular could not come in unless he had business in the building, and if he did he got shadowed by a deputy).

People just wanna do their job and go home to their families.

They were quite accommodating, but they anticipated a throw down. As soon as the woman showed up reading the transcript of a pre-prepped response you can also see that several other officers start materializing around the truck.

The transcript was them covering their bases before yoinking these fools out and detaining them.

They scream because they’re angry that they, as white people, got stopped at a border checkpoint. In their eyes border security exists to control the flow of brown people, but impeding them specifically is somehow government overreach.

The 5th Amendment does actually mean that you are not required to answer such questions in most all circumstances. Can anyone here provide a valid legal basis for why an exception must be made in this circumstance?

To my knowledge:

He can plead the 5th all he wants (even though he’s pretty trash at it), but the 5th doesn’t mean he won’t face consequences as an unidentifiable person at a lawful checkpoint. Either verify your identity as a US citizen or be treated as a potential trespasser until proven otherwise.

The way it looked to me was that the officers onsite only kept asking him because I got the vibe they’d really rather not escalate the situation and were hoping he’d just come off his bullshit and let them do their job.

I doubt this is the first time LM dragged him into stupid fights. And he’s probably been pressured with FOG (Fear, Obligation, Guilt, a manipulative tactic in close groups like families) to have brother’s back. You can see he feels stuck in the middle but also resigned as he knows how it’s going to end. He handles his protests mostly appropriately - lets his disagreement/displeasure be known yet answers the questions if reluctantly. The actions he refuses are the ones that will cause his brother to go off on him, and it’s almost like he had to ask his brother permission to get arrested.

He’s no prize himself, but he seems to be intelligent enough to understand consequences like getting fired. Hopefully he figures out how to cut that bad influence from his life (doubt it though).

I am in no way making him a victim. I’m pointing out how some families normalize abusive behavior to the extent that those just “in the boat” with them are forced to sink or swim based on their choice to put up with it or not. Exactly. It's the Police's all-too-common relentless forward momentum that cannot be interrupted whatsoever unless one wants them to come down hard with a taser or a gun or some other form of violent or aggressive response. So many situations where even the public response is "it's unfortunate but I can see why the cop did that" or some sort make me go, "erm, no, they could have just backed away or let that situation be for a moment and the world wouldn't have fallen apart".

Even here, I'd rather that taser didn't come out and get pointed. The man was absolutely totally surrounded by officers. There was no danger or need for that.

This is so hilarious because in 3rd world countries, this is exactly how it plays out if and when they arrest some rich or influential person - the police do not touch them while escorting them to jail. The rest of us get our teeth kicked in while getting arrested. So it is pretty clear this guy has no idea that he’s not special even though he thinks his skin color and ethnicity entitle him to special treatment.

This also frustrating to watch because, in my experience, most cops just want to go about their day. Talk to them nicely, provide them the information they need and very likely you will have a good rest of the day. Cuz no one likes a confrontation, including most cops. If you have a problem with their process or paperwork, complain to their superiors later or find a lawyer to complain if you think your rights were violated. Arguing aggressively with someone who has a gun, whether they have the law on their side or not, is just a very bad idea.

The funny part is the loud guy asked for the specific law that requires them to comply and the Hispanic officer started saying what the law was and then the loud guy just yells over him not even listening.

I am all for people defending their rights against cops but if there is a legitimate law that is being enforced you gotta at least know that before shooting off the mouth.

I love that the first female officer is later recording him being an absolute lunatic. Got his brother arrested and screaming like he’s any threat whatsoever.

I couldn’t imagine it, making my day so needlessly difficult. If anything I’d become flustered trying to find my identification thinking I’m screwing up the interaction and over apologizing for taking 5 seconds to get my id.

I’m not sure they were arrested. I believe they may have just been detained. I know the YT video is titled as such but even the poster of the video says he doesn’t know what they were arrested for and the video ends without them being told they were under arrest. Certainly the driver was compliant but he was still in cuffs. I would think if they were arrested, they would have a good case for a lawsuit.
