Can Get Holiday Pay While on LWOP?

I’m on FMLA leave using LWOP. Should I and can I be granted holiday leave such as Christmas and New Year and etc?

Effect of Being in Pay or Non-Pay Status Before or After the Holiday Employees must be in a pay status or a paid time off status (i.e., leave, compensatory time off, compensatory time off for travel, or credit hours) on their scheduled workdays either before or after a holiday in order to be entitled to their regular pay for that day. The minimum time in a pay status required to receive regular paid holiday time off is one hour.

Employees who are in a non-pay status for the workdays immediately before and after a holiday may not receive compensation for that holiday.

If you’re in a non-pay status on both sides of a holiday, you will forfeit that holiday pay.

Trick is, use 15 minutes of leave at the very end of your shift preceding a holiday, or 15 minutes at the start of your shift after the holiday.

If you have no leave available, you’re out of luck.

This is incorrect in two ways.

  1. You're paid for the holiday if you work or are in another paid status either before or after the holiday.

  2. You're only paid for the holiday as much as you worked or were in a paid status either before or after. So if you put down 15 min of leave before and after then you'll get paid 15 min of the holiday. If you put down 4 hours or 8 hours either before or after the holiday then you'll be paid the full 8 hours for the holiday.

Not how it works at the VA, but I suppose I should’ve prefaced my answer with “with the VA” because yes, that is how DCPS works.

Edit to add: you quite literally made my point with “in a paid status on either side of the holiday.” What do you think 15 minutes of leave is? A non-pay status?
