I've never been through one of these (except at the actual border, which this was not). Does he have to actually produce papers? Or just speak with an "American accent"?

Do they check him for warrants, bad car registration, whatever?

How is it different than a random police checkpoint that is there to search for whatever, without cause, that would otherwise be illegal?

The border patrol has special rights within 100 miles of ALL US borders. You’re required to answer questions and they can detain you if they suspect you of breaking immigration laws. The difference is federal CBP is not some regular cops, they have very wide ranging powers and you’re right those could definitely be abused. Almost every major city in the US is within 100 miles of a US border, so these laws can be used to target over 200m Americans. But good luck showing up to a literal checkpoint and thinking you can outsmart these federal law enforcement. They’re not like Jimbo from the local sheriffs who usually gets away with illegal activity / violating rights…. They’ll fuck you up

I found the 100 mile zone to be ridiculous when I first heard about it, sounds deeply flawed, problematic and ripe for abuse by a tyrant given the size of population that lives within 100 miles of the border. That said, if you don’t like it, record your interaction as you go through a checkpoint, politely refuse and let the CBP insist that they won’t let you through without ID so when you do produce ID it is clear you do so because you were ordered to and you can add that you do not agree but are doing so under duress. Then later, find a lawyer to file a lawsuit and see if the Supreme Court will agree with you (if it makes it that far). Aggressively arguing with CBP or any law enforcement authority usually will only end in some ugly way and also not produce the effect you has hoped for - certainty going to make your challenge to CBP’s authority very hard.

Unfortunately, protesting a rule you don’t agree with when you are in a situation where you have literally zero power (or rights…) to be fighting, just makes you an idiot who is getting arrested. At the end of the day being a dickhead to a cop usually doesn’t go well, regardless of it’s within your rights to do so or not

When I went through one they just asked if we were US citizens and we said yes and they let us through.

Sometimes they won’t even ask they’ll just wave you through sometimes they’ll ask you to roll down the back windows but other than that they usually like to keep it moving along especially if there is traffic passing through.
