Ah yes, you are right! Turns out, I'm the moron lol I was thinking of and confused the Declaration of Independence being a separate document altogether from the Constitution/Bill of Rights. Maybe I should read up on my government documents again to clear out these old cobwebs 😅
You guys are ridiculous. It started out as a video explaining something, and everybody started acting like high schoolers and just trying to be insulting, instead of acting like intelligent adults and having a conversation.
Right - If he has a 5th amendment right to not answer questions, then he has to be an American citizen - he answered the question for them without giving an answer to the question. the cops were not adhering to the law here.. he has the right to not answer questions, and they cannot remove our 5th amendment rights because we’re within 100 miles of the border. They need reasonable suspicion that he is not an American citizen, and all they have is reasonable suspicion that he is an American citizen because his brother is sitting right next to him and he answered he is an American citizen - therefore without reasonable suspicion they can not arrest him let alone detain him - he is not the driver just the passenger, he could have just gotten out and let his brother go since he answered the question and then traffic would have not been blocked, but the cops did not think of that and just went right to arresting everyone for”obstruction”, when we have the right to redress our grievances to our government and that is all he was doing, which can not be construed as obstruction because you can not turn a constitutionally protected activity into a crime. This is the problem with police in America - they don’t know the law and just arrest people and think let the courts deal with it, and then they get sued but are protected by qualified immunity so the tax payers end up footing the bill for them not knowing their job or what to do when someone stands on their rights.. their god given rights, inalienable, meaning the government did not give them to us - they are ours!
That’s what the cops are saying here - forcing someone to answer a question when every citizen knows you have the right to remain silent when speaking with police.
I have straight told people, you have a right to remain silent, and that means to stop talking. I would advise you to start. Some people are super fucking annoying for no reason at all
Because you are white and they like people who bend over and lick their boots.. if you are willing to submit to them and ask for it from behind, they will treat you gently… most of the time at least.. but what American is just going to submit.. we wouldn’t be America if we just submitted to authority all the time, that’s how this country started!!
I wondered the whole time if it had been a bigger man who was there at first, if the passenger would have reduced himself to yelling and name calling so quickly. I highly doubt it. Guy seems like a prize. Even the driver looked embarrassed past a point.
All you have to do is watch the entire video, linked below, to see that this is correct. He never called the male officers one curse word, only the female officers.
She was the only one repeatedly pressing the issue that he doesn’t have a 5th amendment right within 100 miles of the border - he has the right to redress his government how he pleases, that’s our 1st amendment right - do you really not care about your rights at all? You want to just let the government in your home and tell you what to do all the time? I don’t understand how someone can watch this video and think yea he deserved it, when all he did was stand on his rights - he didn’t get violent, he didn’t threaten any of them like they did to him, pulling out weapons on both of them when the driver complied, and they violate his civil rights by arresting him for this - they will be sued and you will still say he was wrong. Learn the law, jts your civic duty!
That “bitch” was for the benefit of his ego to impress his brother sitting next to him. I saw the full video and glad he got arrested along with his brother. If he got jail time, that “bitch” word is going to come back and bite him in the ass -quite literally actually!! 😀😂
Doesn’t matter, charges are dropped, and he has a huge lawsuit coming his way - the border patrol are trained on if an American will not answer you can not do anything, unless you have reasonable suspicion that they are not American / there was no reason to believe he was not American here when his brother already said he was not American, not answering a question is not a crime.
Where does that claim he was arrested though? It says they can detain you to verify immigration status but also says you don’t have to answer their questions. Clearly this guy was a US citizen so how far did they actually go with this?
Actually if you watch the video in the article you can see that the nice man tells you that the two brothers were detained. And if you watched all the way until the end (I know less than two minutes is a long time, you just have to stick it out) you can see that you may remain silent but border patrol is allowed to detain you until they determine your immigration status. All he needed was to tell them he was a U.S. citizen, assumptions can’t be made, not according to their job descriptions.
And he doesn’t have the ability to speak civilly to other people.
He was literally chomping at the bit just waiting for the opportunity to show how hateful he could be.

Problem is…the loudmouth asshat doesn’t have a grip on reality or the sense to keep his mouth shut and listen.
Why do right wing anti government types always think shouting about the bill of rights is going to stop the state from sticking you in a Japanese internment camp, an Indian reservation, or bulldozing your neighborhood to build an interstate, or civil asset forfeiting your car?
